Lower compulsory portions in the Swiss inheritance law

Modernisation of the almost century-old inheritance law of Switzerland: In future, testators will be able to freely dispose of a larger part of the estate. This was approved in the 2020 winter session of the Swiss parliament. What does it mean?

Today, children are entitled to three quarters of the legal share of the inheritance as a compulsory share. This entitlement is divided in half with a surviving spouse.

The children’s compulsory share will now be reduced to half. The compulsory portion of the parents is cancelled.  The compulsory share of the spouse or registered partner is left at half of the statutory inheritance entitlement.

If there is no referendum by 10 April 2021, the amendment will enter into force on 1 January 2023.
