Today, children are entitled to three quarters of the legal share of the inheritance as a compulsory share. This entitlement is divided in half with a surviving spouse.
The children’s compulsory share will now be reduced to half. The compulsory portion of the parents is cancelled. The compulsory share of the spouse or registered partner is left at half of the statutory inheritance entitlement.
If there is no referendum by 10 April 2021, the amendment will enter into force on 1 January 2023.
